Garrett first-degree murder trial underway

From the Cleveland Daily Banner: A Cleveland man who pled guilty to possession of a firearm by a convicted felon has been transferred to Bradley County, where he faces trial for first-degree murder.

 

Charles Franklin Garrett, 44, allegedly killed a man in 2021, but it wasn’t the man he intended to kill.

 

According to the indictment true bill, on March, 7, 2021, Garrett “did recklessly kill Xavier Rouse, during attempt to kill Jordan Myers.”

 

As a case of transferred intent, in that Garrett allegedly killed Rouse “intentionally and with premeditation” in an effort to kill Myers, Garrett has been charged on six counts:

• First-degree murder;

• Attempted first-degree murder;

• Felony murder;

• Possession of a firearm by a convicted felon;

• Employment of a firearm during commission of or attempt to commit a dangerous felony (attempt to commit first-degree murder); and

• Employment of a firearm in the commission of a dangerous felony while having a conviction for a prior dangerous felony.

 

Garrett’s previous conviction was for aggravated burglary in 2013, and he had most recently been serving a 15-year sentence in relation to his possession of a firearm while being a convicted felon.

 

Transferred by the United States Marshal Service from Irwin County Detention Center in Ocilla, Georgia, he returned to Bradley County on Nov. 28, and began trial in Bradley County Circuit Criminal Court on Tuesday, Dec. 12.

 

Presently, he is held on a $500,000 bond.
