Topping our news today…

New charges have been filed against a Cleveland man accused of shooting and killing his fiancée’s uncle early Sunday morning.

Matthew L. Wolfcale now faces a charge of domestic assault, in addition to the second-degree muder charge from Sunday morning’s shooting.

According to Ashley Wilson, she and Matthew got into a verbal argument over a cell phone that escalated into a physical altercation between the couple. During the altercation, Matthew grabbed Ashley while she was holding their one year old child and pushed her down onto the bed. The situation escalated and Ashley’s cries for help were heard by her Uncle Jesse who entered the room and stopped Matthew from assaulting her.

When Jesse Johnson entered the room, the two men fought, and Matthew Wolfcale shot Johnson.

Detectives noted red marks on Ms. Wilson’s neck, in line with her statements about the incident. Due to Ms. Wilson’s statement, as well as her minor injuries from the altercation, Matthew Wolfcale is determined to be the primary aggressor in the altercation that took place between the couple, and is being charged with domestic assault.

No injuries to the child were reported.

A federal judge Tuesday dismissed the lawsuits filed on behalf of former Ooltewah High School principal James Jarvis, former athletic director Allard “Jesse” Nayadley and former coach Andre Montgomery against the Hamilton County District Attorney’s Office and others in the handling of the Ooltewah High basketball players rape case in 2015.

Three other, related federal lawsuits were also dismissed by U.S. Magistrate Judge Christopher Steger, by the same school administrators.

The motions were dismissed ‘with prejudice’ in the federal cases, but ‘without prejudice’ at the state level, leaving the door open for additional lawsuits under Tennessee state law.
