A 24-year-old man was shot late Saturday night near the Cheesecake Factory restaurant at Hamilton Place Mall in what police call a possible robbery attempt

Chattanooga police say that officers responded to a call of shots fired about 11:49pm Saturday.

When they arrived, they found shell casings in the parking lot and secured the scene.

Moments later, they were notified by dispatch that a man had arrived at a local hospital suffering from gunshot wounds.

The man has what police describe as non-life-threatening gunshot wounds

Investigators learned that the man was sitting in a vehicle in the parking lot when a suspect approached and began shooting, striking the man.

Ronald Andrew Hutson has filed a federal lawsuit against Hamilton County, Hamilton County Sheriff Jim Hammond, and Hamilton County Deputy Jordan Long-Ross.

Hutson’s lawsuit claims Deputy Long-Ross violated his Constitutional rights, and “used unreasonable, excessive, and potentially deadly force” against him. It says Hutson suffered “serious, lasting and permanent injuries, both physical and psychological” from the shooting.

Hutson is seeking $1.8 million in damages, and wants a jury to hear his case.

Court documents show that on Saturday, August 22, deputies tried to pull Hutson over for failing to stay in the lines on the 2900 block of Corral Road.

The arrest affidavit says Hutson did not pull over, and then later crashed.

According to the document, Hutson then drove backwards toward Deputy Jordan Long-Ross, nearly hitting him. Officials say Long-Ross then fired his gun, hitting Hutson twice.
