Autumn Hughes reports: A Cleveland man remains in federal custody for his alleged attack Jan. 6, 2021, on the U.S. Capitol.

Joseph Lino “Jose” Padilla appeared Wednesday morning at a status hearing held via video conference in U.S. District Court for the District of Columbia before Judge John D. Bates.

However, due to Padilla having new defense counsel and government databases not being available for Padilla and his counsel to review — and Padilla not having ready access to a device so he can review evidence — a status conference date was moved to April 6.

Padilla, who turns 41 this year, has been held without bond since March 30, 2021, pending trial. He was arrested on Feb. 23 outside his Cleveland apartment for joining thousands of dissidents who stormed the Capitol in protest of congressional proceedings to certify the results of the 2020 presidential election.

Padilla faces a 12-count indictment by a federal grand jury on charges that include obstruction of law enforcement during civil disorder, assaulting a law enforcement officer with a deadly or dangerous weapon, and violent entry and disorderly conduct on Capitol grounds.

Padilla is represented by Ed Martin and Michael Cronkright, who are also lead attorneys in the federal government’s case against Proud Boy William Chrestman, of Kansas. Martin, of Missouri, and Cronkright, of Michigan, took over Padilla’s case in November.
