On Thursday, October 7th, at 9:06 a.m., Cleveland Police Department officers responded to a mental disturbance at 735 Springhill Drive NE in Cleveland. Responding officers received information from the Bradley County 911 Center that the male subject was armed with a firearm. Upon their arrival, the officers exited their vehicle and encountered a white male armed with a shotgun. The male was given repeated verbal commands to drop the weapon, however, he continued to advance toward officers. At one point, while the male was walking toward officers, he fired a round from the weapon. After continued verbal commands issued to the male to stop and drop his weapon were ignored, two Cleveland Police officers discharged their department issued firearms, striking the male subject. The officers immediately called for EMS assistance and attempted life saving measures. Per Cleveland Police Department protocol, the District Attorney’s Office and the Tennessee Bureau of Investigation were contacted, responded to the location, and assumed responsibilities of the investigation. The male subject was transported by EMS to a local hospital, where he was pronounced dead. The Tennessee Bureau of Investigation has identified the deceased as Lloyd Grant McClung, Jr.

The three Cleveland Police Department officers involved were not injured during the event and were placed on paid administrative leave, which is routine per Cleveland Police Department policy.

Miranda Cheatam, who was sentenced to 18 years in prison back in 2019 after being found guilty in the Halloween 2016 murder of her husband, James “Toooter” Cheatam, was denied her motion for a Judgment of Acquittal in Bradley County Criminal Court today. Per the Honorable Judge Don R. Ash, based on the record as a whole, the arguments of the parties, and all applicable legal authority, the court respectfully denies the defendant’s motion. The evidence is sufficient to support the conviction of second-degree murder. Additionally, the court denies the motion for a new trial regarding all claims made by the defendant. In addition, the defense has failed to prove any newly discovered evidence affected the defendant’s opportunity for a fair trial. 

Mix 104-1 News received the following statement from District Attorney General Steve Crump:

“Today’s ruling in State v. Miranda Cheatham returned the focus in this case to its rightful place, the murder of James Cheatham by Miranda Cheatham.

I am grateful for the dedicated work of Assistant District Attorneys John Zimmerman and Allyson Abbott, who handled the case after our recusal. They were relentless in searching for the truth and justice. I also want to commend Assistant District Attorneys Coty Wamp and Drew Robinson for their work in the original trial of this case. Cleveland Police Department Detective Daniel Gibbs’ work was thorough and the key reason for the conviction.

The whole purpose of my recusing the office was to allow for a complete independent review of this matter so as to remove any cloud of doubt on the jury verdict and to provide independent confirmation that I and this office followed the law. Today’s ruling does both completely. The ruling is vindication for me. But it is also vindication for the Cleveland Police Department, this office, and most importantly, for the family of James Cheatham.”
