Channel 3 obtained never before heard audio and learned new details on the deck that collapsed at a Soddy Daisy restaurant in May, sending 11 people to a hospital.

Hamilton County has no record of a certificate of occupancy for the property.

Hamilton County Building Inspections told Channel 3 a certificate of occupancy shows inspections have been passed and the building is safe to be in. The county has records of inspections done, but no record of a certificate of occupancy on file, meaning it may not have been a safe place to operate.

On May 1st, a group of 40 people gathered on the deck that collapsed for a 60th birthday party.

The county attorney said the deck was built without the proper permits.

Attorneys with the local law firm Warren and Griffin, who are representing some of the people injured in the fall, say their inspection report shows the deck collapsed from poor maintenance and construction and it wasn’t in compliance with state codes.

Judy Spiegel, the 63-year-old wife of former Erlanger Health System administrator Kevin Spiegel, is among 99 people missing in the collapse of a condo tower near Miami early Thursday morning.

Her children said they had not given up hope that she might be found.

Rescuers were working in shifts to try to pull survivors from the rubble.

Mr. Spiegel was in California at his current job at the time of the 1:30 a.m. collapse.

The labor statistics for May are in. The seasonally adjusted unemployment rate for Tennessee was 5%, the same as in April, and down from 13% one year ago.

Moving closer to home, in Bradley County the unemployment rate was 4.3%, up from 4.2% in April, and down from 7.8% one year ago. McMinn County was at 5%, up from 4.7% in April, and down from 11% one year ago. Meigs County was at 5.1%, down from 5.3% in April, and down from 10.3% one year ago. Polk County’s unemployment rate was at 4.5%, the same as in April, and down from 8.2% one year ago. Rhea County was at 5.6%, up from 5.3% in April, and down from 13% one year ago. Hamilton County’s unemployment rate was 4.3%, the same as in April, and down from 9.4% one year ago.
